This client's case was particularly heartbreaking because the child was a mere infant. However, due to Covid, NYC Family Courts are not treating circumstances like this an emergency, unless there is a safety concern involved. The court may not have considered this parent being deprived of access to her child for two weeks an emergency, but we did. So when the Family Court calendared her case for one month out, we explained alternate options to our client---allowing any paren...t to go six weeks without seeing their infant child is simply not an option. So we got her in front of a Judge in Supreme Court the very next day, with an immediate return of the Child, and a shared access schedule, with the father eventually agreeing to give our client full custody. Not at all! You will not be "penalized" for initiating the divorce. In NY, there is a presumption that the more moneyed spouse will pay attorney's fees for the less moneyed spouse. The idea behind this is to put both spouses on equal footing. Responsibility for counsel fees has nothing to do with who files, rather its about who the higher earning spouse is.

In addition to Basic Child Support, which is based upon a percentage of the non-custodial parent's gross (pre-tax) income, parents must also share in paying for child care. Childcare expenses can include anything from daycare to before and after school care, as well as summer camp--put simply, any work-related childcare expense will be shared by both parents in an amount proportionate to their respective incomes. For example: if Parent A and B both earn $50k each, they will e...qually share the expense of child care; if Parent A earns $100k and Parent B earns $50k, Parent A will be responsible for 66.6% of the childcare expenses, while Parent B is responsible for 33.3% of the childcare expenses (the combined parental income would be $150k--Parent A's income accounts for 66.6% of this and Parent B's income accounts for 33.3% of this). This is what court looks like for me in 2021. #NYcourts (downstate at least) are still operating virtually. I love virtual court. It's so much more efficient and also saves clients tons of money in legal fees because I am simply logging in and doing their appearance. In the past (and in the actual courthouse), we would sometimes be sitting around all day waiting for a case to be called. Now, even if I am waiting for a case to be called, I am sitting at my desk and doing other work. Clients are being billed a fraction of what they were before, they don't have to lose an entire day of work, and I don't have to drive all over the boroughs and long Island. Win win. A little positive news for you. While half of all marriages ended in divorce previously, the divorce rate in the US has actually been on a steady decline for decades. We are at an all time low, even with the pandemic. In fact, 58% of couples say the pandemic made them appreciate their spouse more and deepened their relationship. Once you are served with divorce papers, the clock starts ticking. If you are served within NYS, you have 20 days to put in a "Notice of Appearance" (if you are served outside of NYS, you have 30 days). A few things to note: 1. A Notice of Appearance is not an actual appearance in court, it is a document that is filed with the court. Essentially, this is your way of letting the court know that you are intending on participating in the action. 2. Proper service on a divorce a...ction requires personal in hand service (unless the court grants permission for an alternative method). This means you generally must be served by an individual over the age of 18 that is *not* your spouse. They cannot leave the paperwork at your door or mail it to you. 3. Making the decision to proceed with divorce is one of the most difficult decisions my clients make. Oftentimes, people consult with me for months, unsure of whether or not they are prepared to take the step toward divorce, or if things will change if they give it one final shot. So many of my clients do try and give it one final shot, then another, and then another. Ultimately they wind up proceeding. Sometimes they find themselves in more disadvantageous position than they w...ould have been the first time around. While I follow my clients' lead and allow them to take as much time as they need (because I appreciate the gravity of what is at stake), I also encourage them to take a realistic look at the circumstances. And what the price of waiting will be. Sometimes it gives their spouse a chance to hide assets, or to coach the children or "buy" their love with gifts to benefit their position with respect to custody. In situations where the client is unsure if they want to file, I make it a point to lay out the steps they should take to protect their interests, while also allowing time to think. Always remember: consulting with an attorney does not mean you have to do anything, ever. It simply allows you to be aware of your rights and understand the law. Parenting in covid means I haven't seen these tiny humans all week because I've had a trial-heavy week and my husband had a busy week and couldn't manage online schooling+400 requests for snacks+30 bathroom trips, along with his work obligations. Kids are with their grandma. Miss them so much but they come home today and SO excited to see them. Just need to get through this day! At this time last year, we never could have imagined what life would look like only 3 months later. Life is so unpredictable. The way we practice law has changed so dramatically. Many of the calls I receive begin something like this: Caller: I'd like to get an uncontested divorce Me: Sure, have you and your spouse agreed upon all issues relating to custody, support, and the division of assets?... Caller: We haven't spoken about it. So many people misunderstand what an "uncontested divorce" is. An uncontested divorce is one where the parties have already agreed upon the above issues and are simply seeking to have an attorney prepare and submit the paperwork. Through talking with so many potential clients, I've come to realize that when people call to inquire about an "uncontested divorce" what they are actually referring to is the fact that they prefer not to spend years and thousands of dollars litigating. The good news is, 95% of cases *do* settle. But this can happen at various times. Sometimes, it takes one or two court conferences to get the parties to the emotional space where they can see that settlement is in their best interest. I always tell clients not to fear the process. Its more important to get the best result than the quickest result.
