It has been a recurring theme when talking with people who are dealing with a spouse seeking a divorce and who have tried to do it themselves, defending against a not-yet-ex who has hired an attorney. The idea, they say, is to save money, because they thought they were certain that their ex would be fair, and then, suddenly, after the Preliminary Conference, when they've been pressured into a stipulation, they realize that they can't afford it - that they're paying out more m...oney than they can possibly afford. And they're desperate for someone to fix the problem before they have to devastate their retirement accounts. The bad news is that by then a lot of damage has been done, and it's far from certain that a quick fix can be put into place, because the other side is now getting more than they will after the final settlement, and thus has no desire to do anything other than delay. The easy lesson is that saving money by not paying a lawyer from the start of a contested case can cost quite a bit over the course of the litigation. And trying those first months pro se can actually increase the legal fees you pay when you finally realize you can't effectively fight the lawyer representing your spouse. I know, it sounds a bit self serving - but you can ask those who've tried going it alone through the Preliminary Conference only to see a bad stipulation on custody or child support or spousal support - and once you've signed most judges are very reluctant to give you a fresh start - they say settle and you can make any deal you want. One of the provisions of the 2018 Tax Law makes a big difference to many people who are getting a divorce, particularly those who anticipate paying spousal support, also known as maintenance or alimony. Under the new tax law, if your settlement agreement or Judgment of Divorce containing a provision for spousal support is signed after Dec. 31, 2018 the spousal support/maintenance/alimony will not be tax deductible to the payor. This change does NOT change the deductibility of any previous agreement or court order; if your settlement agreement or Order is dated on Dec. 31, 2018 or prior the payments will still be deductible even after the new law takes effect.
