In most cases, an act may involve facts that can make it the subject of both civil litigation and criminal prosecution. A civil case usually involves a dispute ...between private parties, while a criminal act is against the State or other sovereign entity. Hence, a civil case may be initiated and litigated by the aggrieved private party. On the other hand, a criminal case is handled by the State, through a designated state prosecutor. Generally, the filing of the criminal case automatically includes the civil claims of the injured party. Thus, unless the latter specifically reserves the right to pursue a separate civil action (apart from the criminal prosecution), the fate of the civil claims will depend on the outcome of the criminal case.
