The House and Senate have both passed their own version of the new tax law. Before the law goes into effect, we could see changes to the bill, but we have a pretty decent idea of what many of the changes will be going into 2018. Some of the changes will be huge and will have great impacts on the country, especially real estate. The biggest change is to the tax-free gain from selling a personal residence. Right now, if you live in a house for two out of the last five years, y...ou can sell it and take up to $250,000 (individually) or $500,000 (jointly) in tax-free profit. The new law in both the House and the Senate would change that to 5 out of 8 years. The House bill would even phase out the tax-free gain for high-income earners. New real estate laws are always coming into effect. Work with the firm that keeps up to date with every aspect including this change below: Preventing Zombie Homes: this law takes effect December 20, 2017, and requires certain banks that originate or own mortgages to secure and maintain one- to four-family residential properties which are deemed to be vacant and abandoned. This part requires the Department of Financial Services to maintain a statewide vacant and abandoned property registry for the tracking of such properties. This part also requires banks to provide to homeowners a clear notice of a homeowners’ rights during the foreclosure process. #themoreyouknow #realestatelaw

Estate Planning 101: The Basics Learn more at www.DPC-Law.com What happens if I die without a Will? Most people think that if they die without a will, their spouse will automatically get everything. This is NOT the case... Dying without a will is called "intestacy." If you die without a Will ("intestate") the laws of New York State dictate who will administer your estate and to whom your property will pass. Many people are surprised by what the intestacy laws say. For exampl...e, if you are married and have children, your property will not automatically pass to your spouse. Instead, your spouse will receive the first $50,000 from the estate, and the balance will be split between your spouse and your children. If your children are minors, the assets will be placed into a special custodian account with a person the court names as custodian. Your spouse may need to account to the court as to how he or she spends the share that has passed to the children.
