After issuing a landmark decision requiring law enforcement authoritites to obtain a warrant before attaching a GPS device to a criminal suspect's car, the state Court of Appeals revists the issue in Matter of Cunningham v. New York State Department of Labor. In Cunningham, the state attached a homing device to the personal car of a state employee suspected of falsifying records of his working hours. On May 29 the Court of Appeals will hear the issue as to whether the state needs a warrant to track its employees, or if the workplace exception applies. Keep an eye on this case, as it will have a profound effect on criminal procedure!
