We just completed UB Law's Fall 2020 "Legislative Redistricting" class, LAW 743. In the image below we are participating in a Zoom session with "District Builder" the open-source redistricting software. The image on the screen is a famous one (for the small universe of redistricting nerds), Pennsylvania's 7th Congressional District known as "Goofy Kicking Donald Duck." The Pennsylvania Supreme Court unanimously dismissed the Trump Campaign’s legal challenge, finding it without merit. Two justices dissented to say that the case never should have gotten as far as it did.

Trump lawsuit filed yesterday in United States District Court of Pennsylvania, Middle District (Williamsport) seeking to delay certification of the Presidential race. Worth a read. A few points: 1. The only claim in the lawsuit is a 42 USC 1983 (civil rights) claim based on vote dilution. This is fundamentally wrong, as vote dilution as a legal theory rests upon the Fourteenth Amendment's guarantee of equal protection of law.... 2. The "vote dilution" theory is based upon allegation of "illegal votes" that "diluted" legal votes. 3. The lawsuit contains no evidence of "illegal votes," only references to websites making claims, such as "[i]n Montgomery county, a poll watcher overheard unregistered voters being advised to return later to vote under a different name that was registered in the poll book." 4. Recall that McConnell justifies violating his own rule of not confirming Supreme Court justices in election years by citing the fact that the Senate increased its majority in the 2018 midterm elections. This, he says, reflects, a national consensus expressing unqualified faith in the GOP's actions. This article demonstrates the absurdity of such a claim, as Democrats won millions more votes in 2018. Further, if the GOP cannot ram through their nominee with a Covid-depleted Senate and Judiciary Committee and they lose seats on November 3, they will have lost any tenable, legitimate claim to fill Justice Ginsburg's seat.
