On this day in history: September 24, 1789 - President George Washington signed the Judiciary Act of 1789, which established the first Supreme Court of the Unit...ed States. The Act declared the Supreme Court to be made up of six justices. That same day, President Washington nominated John Jay to serve as the first Supreme Court Chief Justice, and two days later, his appointment was approved by the U.S. Senate. The number of justices of the Supreme Court varied until 1869, when the number was set to nine. Constitutionally, appointments of Supreme Court justices by the president must be approved by a simple majority in the Senate (at least 51 votes).
