Dirty Trick #5 / Hiding Assets : It is hard to divide property you don’t know exists. Unreported cash, loading up on gift/prepaid cards, putting property in a relative’s name or possession, having an employer defer a bonus or a raise until after the divorce, are just a few examples. The best defense to this dirty trick is to have an attorney that knows what to look for.... Dirty Trick # 2 Using Spyware : Digital evidence is a whole new playing field in divorces. There are many ways a motivated litigant might try to hack into email, social media and other online accounts to look for dirt. Quick advice - the same laws that make it a civil or criminal offense to access anyone else’s online accounts, also apply to spouses. Even if no spyware was involved and the curious spouse just guessed the correct password - still "unauthorized access". ... Evidence obtained by spyware or hacking is likely to also be inadmissible at trial and grounds for sanctions. Better to have an experienced attorney conduct your "Discovery". Trying To Conflict Out The Best Attorneys In Town:... Attorneys owe a duty of loyalty and confidentiality to every client. So some spouses try to get an unfair advantage by searching for the Top Rated family law attorneys and meeting all of them for a one time confidential consultation. Then if the opposing spouse seeks to hire one of those attorneys, that attorney could well be conflicted out. Seasoned attorneys are on the lookout for this dirty trick and courts strongly frown upon litigants who do this. There is a well known local case published on the subject. It is a bad way to start. An update has been made to NYS law on Orders Of Protections. Criminal and Family Court can now specifically order that a person may not access "any device affecting the home, vehicle or property of the victim ... by internet or bluetooth connection". This is to prevent an alleged abuser from getting into smart devices, such as Ring Doorbells, home alarm systems, smart tvs, thermostats and home wifi systems - while the Court determines the case.... The "Virtual" Family Court is now in session in Monroe County. Here are 10 quick tips to prepare to win on a remote court appearance : 1. / Device Make sure you have access to a working, updated device - and that it is fully charged. ... 2. / Backup Plan Have a backup device ready. 3. / Log-In Info Keep your Log-In info handy in case the connection drops. 4. / Headsets Help Wear headphones with an attached microphone. Sperm Donor Law : Law is not always boring. Last month, a surprising ruling came down from a NYS court, holding that a man who thought he was only acting as a Sperm Donor for a friend - was actually the Legal Father of the child conceived from his semen test tube samples. This is what can happen - with any legal agreement - when you don't cross all your T's and dot all your I's. Legal Tip: Evidence 101 To win any court case, you must present evidence to support your legal position. NYS is one of the few states that does not have a statutory code of evidence. The law of evidence is scattered throughout 1,000s of case law decisions, statutes and court rules - which often makes this subject very difficult. To resolve this, the NYS court system has just launched "The Guide To NY Evidence" and posted it online to be a resource for both attorneys and the p...ublic. Court Alert on Monday, June 1, 2020 @ Noon: Hall of Justice closing down for the day "out of an abundance of caution for the safety of all" due to an expected rally. Virtual court proceedings will continue as planned, according to the court clerk's office.
NYS Courts / Covid-19 Update: The NYS court system continues to expand remote operations this week - but Chief Judge urges everyone to "practice patience". Family Court and divorce conferences by Skype are now full speed ahead on backlogged cases. NYS Courts are trying to first clear the huge load of old cases before fully reopening for new filings....
