HUGE victory for one of my immigration clients today! He was seeking Asylum but was likely going to have his case denied (recent case law under the current Administration now requires facts that most people cannot prove, thereby disqualifying them). But he was able to qualify instead for a Special Immigrant Juvenile Visa. This is a great victory for him and his family and means that he can now apply to become a US Citizen!! We are so happy for this great news!

We want to let you know that although our physical offices are currently shutdown due to the Governor's Executive Orders, we are still open for business: We have been facilitating "Virtual" Real Estate closings so that our clients can still buy/sell their properties while safely social distancing; We are closely monitoring how the Governor's Orders impact landlords and tenants affected by the COVID19 pandemic; and we continue to prepare uncontested divorces for when the cour...ts reopen and accept new cases. This pandemic has forced people to think about multiple ways to help protect their family, their assets, and avoid liability for their small businesses. Therefore, we are expanding our practice to offer wills, trusts and estate planning. Why is it important to plan for my estate? + Property owned or transferred into a Trust allows family members named in the Trust to control the property (collect rent, enter into leases, etc) in the event the the current owner becomes unable to do so. This also avoids court hassles and proceedings. + For home owners who are 65 or older, a Trust moves the property/asset out of their name allowing them to qualify for potentially tax benefits and the ability to qualify for Medicaid. + Small business owners can ensure that their business can easily and legally transition to family members and protects the family from the liabilities of that business. Why now? One of the lessons we learned during this pandemic is that when a state Shuts Down, that means all the Courts and their associated services (like eviction warrants or the ability to probate a family member's estate) are not accessible. We now anticipate that when they Courts re-open, they will be extremely overloaded and under-resourced. We are encouraging our clients and small business owners to create health care proxies, power of attorneys, and basic wills to help them stay prepared as the future remains uncertain. During these unprecedented times, its hard to know how to handle issues like paying rent, or, if you're a landlord, how to collect rent. A few things you should know: 1. The housing courts are shut down until further notice, except for essential or emergency matters. 2. Tenants should communicate with their Landlord about their circumstances, how they have been affected by Corona Virus, and should gather supporting documents, if any, to show the impact on their ability to pa...y rent. 3. Landlords can still send notices to a tenant about the tenant's failure to pay rent, by certified mai, in order to preserve any claims for back rent once the courts re-open. 4. Landlords should contact their mortgage banks to apply for any relief from their mortgage payments if tenants are not paying rent. After a year and a half battle, tonight my clients (shareholders in a Coop) won the majority seats on their Coop's Board of Directors election. It is a great victory and involved very intense litigation with an opposition that was willing to pull every trick and play every game in the book. But my clients, my co-counsel, and I remained ethical, professional, and honest and in the end, we won the battle! The war is not over, but the tables have turned! It's a great day to be a private practice litigation attorney.
