NEW YORK's GOVERNOR : NO EVICTIONS UNTIL JANUARY 2021 New York Governor Andrew M. Cuomo announced on Monday September 28, 2020 that he will extend the current New York eviction moratorium - set to expire Oct. 1 - to next year. This will continue protections for tenants and homeowners who have been unable to pay rent and mortgage during the public health crisis. Cuomo will sign an executive order extending the eviction moratorium, known as the Tenant Safe Harbor Act, to Jan. ...1, 2021. The moratorium also protects homeowners from foreclosure for nonpayment of mortgages during the coronavirus pandemic. These moratoriums clearly protect tenants and homeowners. However, what if you are a landlord ? This current situation raises many questions for landlords facing financial difficulties due to tenants who are not paying, and who cannot be currently evicted. Despite the moratorium, there are preliminary steps that we have recommended our landlord clients take. These steps will place them in the best possible position to protect their interests as the situation evolves. Please call us if you would like to schedule a free consultation to discuss your options. We wish everyone well as we all continue to navigate during these unsettled times. COVID-19 UPDATE : McDermott, Pierro & Mandery, LLP remains working for our clients during the COVID-19 Pandemic Situation. As of May 25, 2020, the New York State Courts have indicated that they will accept new matters being filed electronically. Despite this, the New York State Courts are still not working at full capacity due to the COVID-19 situation. We anticipate that there will be a delay in the processing of new court matters, as the Courts will be facing a flood of ...new filings. We continue to monitor updates from the Courts on a daily basis. The health and safety of our staff, and those we come in contact with in our practice, is a top priority. Therefore, in accordance with the current directives of Governor Cuomo for non-essential businesses, our staff continues to work remotely, and have suspended face-to-face meetings with our clients. We do remain connected, are actively monitoring emails and phone messages, and are able to conduct business. We wish you all well, and appreciate your consideration during this time. Thank you. An update from Sharon Simon, Esq., Of Counsel to our firm, who brings nearly four decades of employment/labor law expertise to our work with our business clients: Employers should be aware that the U.S. Department of Homeland Security has issued a revised I-9 form (dated October 21, 2019). These forms are, of course, used to verify employees' eligibility to work in the United States. Forms, in English, Spanish, fillable PDF, and non-fillable paper versions, are available ...on the Department of Homeland Security Website at www.uscis.gov/i-9. Employers may start using the new form now, or they can continue to use the previous form, dated 7/17/17, until 4/30/20. Starting on May 1, 2020, all employers must use the new revised form. If you have any questions concerning how the new law affects you and your business, please feel free to contact us. McDermott, Pierro & Mandery, LLP February 27, 2020

We were very gratified to receive the below review from one of our recent clients on www.avvo.com https://www.avvo.com//11779-ny-robert-mcdermo/reviews.html "A Must Hire... 5.0 stars Posted by Gregory December 5, 2019 I have known Robert McDermott for several years, having engaged him initially to assist my family with our estate planning. Our experience was exceptional. Robert and his team are extremely knowledgeable, efficient and patient as we had many questions throughout the process. My family subsequently engaged Robert and his team to assist in negotiating and settling a family dispute regarding complicated legal issues involving a real estate property. Robert counseled us with practical advice, always being mindful of the economics. As a result, we avoided a contentious costly litigation and all parties were satisfied in the end. Again Robert and his firm were always accessible and patient in dealing with members of the family. I highly recommend Robert in the areas of real estate and estate planning." Melanie Mandery, Esq. of our firm was instrumental in our achieving a positive result for this gentleman's family. December 7, 2019

UNITED STATES DEPT. OF LABOR RULE CHANGES ON OVERTIME ENTITLEMENT The U.S. Department of Labor announced a final rule today that affects overtime entitlement. The rule will result in additional employees being eligible for overtime. The rule becomes effective January 1, 2020. The earnings threshholds have been updated, raising the earnings thresholds necessary for employees to be considered exempt executive, administrative and professional employees. Employers will be permitt...ed to count a portion of certain bonuses/commissions towards meeting the salary level. In the final rule, the Department is: (1) raising the standard salary level from the currently enforced level of $455 per week to $684 per week (equivalent to $35,568 per year for a full-year worker); (2) raising the total annual compensation requirement for highly compensated employees from the currently enforced level of $100,000 per year to $107,432 per year; (3) allowing employers to use nondiscretionary bonuses and incentive payments (including commissions) paid at least annually to satisfy up to 10% of the standard salary level, in recognition of evolving pay practices; (4) revising the special salary levels for workers in U.S. territories and the motion picture industry. It is important to remember that New York State has its own exemption threshholds that change every year. Currently, the threshholds are: (a) $1,125.00 for large employers (more than 11 employees) in NYC; (b) $900.00 per week for employees in Nassau, Suffolk and Westchester; (c) $832.00 per week in the rest of NYS. If you have any questions concerning how the new law affects you and your business, please feel free to contact us. McDermott, Pierro & Mandery, LLP September 24, 2019
