2017 Tax Filing Season Begins Monday January 23. It is important to file early this year for some taxpayers since a new law requires the IRS to hold refunds claiming the Earned Income Tax Credit (EITC) and the Additional Child Tax Credit (ACTC) until Feb. 15. In addition, the IRS wants taxpayers to be aware it will take several days for these refunds to be released and processed through financial institutions. Factoring in weekends and the President’s Day holiday, the IRS cautions that many affected taxpayers may not have actual access to their refunds until the week of Feb. 27. Do not let the IRS hold your money ! Remember to file early.

I was recently asked what is a cram down on a vehicle in a chapter 13 case - the easiest way to explain it is by example: Say you purchased a vehicle 910 days ago, the outstanding loan balance is $25,000 (because you rolled over a bad loan), your interest rate is 15%, and the fair market value of the vehicle is $8,500. In your Chapter 13 plan you propose to pay back the current value of the vehicle ($8,500) over the length of your repayment plan. You can also propose an interest rate of prime rate plus a risk premium which would come to about 5%. The remaining loan amount is treated as unsecured debt and paid back in the same proportion as the rest of your unsecured creditors (usually pennies on a dollar).
