Biden’s immigration amnesty plan: herculean task or feasible reality? Donald J. Trump has created a lot of fear and uncertainty in the U.S. immigration system. All Trump’s rules made it harder for immigrants to receive legal status and has created a lot of confusion among immigration judges and USCIS employees ( I personally received the complaints). So, President Biden has a lot to unpack and he is not wasting his time. Yes. Biden wants unlawful immigrants to finally receive... their Green Cards and even apply for citizenship. Biden has already unveiled his plan in a form of a bill, which still has a long road ahead (must be approved by the Congress, which, luckily, has majority Democrats in it) but gives us an idea on what Biden’s immigration goals are. The bill allows unlawful immigrants to apply for a legal status, which he calls a lawful prospective immigrant if they can show that: (a) They were present in the U.S. before January 1st, 2021; (b) Pass background check ( still unclear if criminal record would be a disqualification); (c) Pays taxes for all years that his or she lived in the U.S. Once in lawful prospective status, the immigrant would have to wait 5 years before being eligible for Permanent Green Card. Notably, Biden wants everyone, who received their Green Card by following the procedure above, to be able to apply for U.S. Citizenship in just 3 years after receiving a Green Card. In sum, Biden is very generous and wants those who lived in fear for years in this country to finally become a U.S. citizen in just 8 years. If President Biden’s plan becomes a law, it is important that you are the first to take advantage of it and file your immigration applications properly and without a delay. See more

I rarely and don’t like to brag about my professional accomplishments, but this case has given me so much satisfaction that I cannot keep it to myself. My clients (a family) have been discouraged to try their case by multiple organizations and congressional representatives to whom they pled for help. No one thought their case could be won and the stakes were just too high (the mother has a very rare and deadly decease, which is not treatable in her home country). Nevertheles...s I took the risk and filed the case. The asylum office took the same position as the mentioned organizations and sent the family into removal proceeding. The judge assigned has over 70% denial rate and DHS trial attorney (prosecutor) kindly suggested that I wait for Biden to take power because I would otherwise lose the case. When I refused, I was offered many options, none of which would give my clients a legal status (just because the case was not winnable but very sympathetic due to the health condition of the wife). I kindly refused and told both the Judge and prosecutor, I was ready. At the end of the trial the Judge was on my side and convicted the prosecutor not to appeal. Whoo-hoo! My clients are on their path to citizenship and God just smirked at me. Only the hardest job gives most satisfaction. Now I have to deal with never ending migraine caused by enormous stress of trying the case. See more

The Attorney General of the United States, Jeff Sessions, a puppet of the executive branch, has recently removed an immigration judge from a case because he had chosen due process over the AG’s whim. What a regress.
