Congestion Surcharge (Temporarily on Hold) Earlier this year, the State of New York amended its tax law (Article 29-C of the New York State Tax Law) to impose the surcharge to help fund repairs and improvements to the New York City subway system. As of the new year, January 1, 2019, FHV bases MUST add a $2.75 per trip surcharge to all trips on intrastate trips that travel in or through Manhattan, south of and excluding 96th street (the "congestion zone"). On December 19, 20...18 a lawsuit was filed by a group representing the interests of the yellow taxi industry seeking to invalidate this law because it is arbitrary and capricious. In other words, the lawsuit claims that since the taxis are not the cause of increased congestion, there is no rational basis to impose a congestion surcharge on the taxis On December 20, 2018, a Justice of the New York State Supreme Court issued a temporary order restraining the State of New York and the New York City Taxi and Limousine Commission ("TLC") from enforcing the congestion surcharge until a hearing is held on whether the Plaintiffs will be irreparably harmed pending the outcome of the lawsuit. A hearing is set to be held on January 17, 2019 as whether to grant an injunction restraining the State and the TLC from enforcing this law until the conclusion of the lawsuit. For a number of reasons, most livery base owners are unable to comply with this new law. The Livery Round Table disagrees with the Congestion Surcharge and is actively evaluating the legal options available to the industry so as to protect its interests.
