SUGGESTED CLOSING PROCEDURES COVID-19 Closing Procedures: Real Property Abstract & Title Services, LLC recommends the following closing procedures for the safety and welfare of al...l during this National Health Emergency: For closings where you represent the Purchaser: We ask that the Seller’s attorney have their client pre-sign the deed and ancillary documents and forward same to either our office, or to purchaser’s attorney to be held in escrow. We will arrange wire, or overnight checks to the Seller’s attorney’s office upon closing completion. In the spirit of efficiency and to promote accuracy, we encourage communication with our title company in advance to review the report to clear objections and fulfill any closing requirements. Client Identification should be obtained and secured for a later encrypted distribution protecting the sanctity of personal private information. For ALL closings we ask that non signing persons and parties attending be kept to the minimal necessity, to reduce foot traffic and lessen exposure. Recent Executive Order of NYS Governor Andrew Cuomo, has made temporary allowance for Remote Online Notarization (RON). The title insurance underwriters have formulated policies and procedures to accomplish this while steadfastly protecting consumers in the transaction. We will be glad to elaborate the methods available to utilize RON.

New Legislation signed regarding mortgage foreclosures Governor signs law amending RPAPL 1302 Removes lack of standing as defense in foreclosure actions In spite of our optimism following our meeting with the Governor’s staff, the bill A5619/S5160 was signed and chaptered on December 23, 2019 with none of our suggested revisions. (See button below for link to text of the bill.) ... The change in RPAPL 1302 takes effect immediately. Prior to this amendment, pursuant to RPAPL 1302 the plaintiff in a foreclosure action must be the owner and holder of the note and mortgage to have standing to commence an action in foreclosure. The affirmative defense of lack of standing must be made at the time the defendant answers the complaint or this defense shall be deemed waived. With the new amendment, 1302-A, the defense of lack of standing can no longer be waived and can be raised at any time even after the conclusion of the foreclosure action and sale if the defendant defaulted in the foreclosure action. The amendment only applies to home loans as defined in RPAPL 1304(6)(a). As a result of this new amendment, the preservation of the defense (similar to the defense of lack of service), renders the title derived through a foreclosure sale unmarketable; BFP’s will always have the threat of litigation by the foreclosed owner. Consequently, when insuring titles purchased from foreclosure sales, each underwriter will have to determine whether to take on the risk of future litigation. A5619 / S5160
