Earlier today, Governor Cuomo signed an Executive order enforcing restrictions on any non-essential gatherings beginning Sunday, March 22 at 8PM, excluding essential services. All non-essential gatherings of individuals of any size for any reason are temporarily banned. 100% of the workforce must stay home beginning Sunday, March 22 at 8PM, excluding essential services. Non-Essential services include but are not limited to, bars, restaurants, gyms, movie theaters, casinos, a...uditoriums, concerts, conferences, worship services, sporting events, and physical fitness centers. The foregoing non-essential businesses must remain closed and are not eligible for designation as an essential business Essential services include: Essential Health Care operations, grocery stores, laundromats, automotive repair, gas stations, building cleaning and maintenance, banks, payroll and accounting services, law enforcement, and technology support for online services, and the like. Any business that only has a single occupant/employee has been deemed exempt, and may remain open. In addition to the foregoing, the Executive order includes the following directives: - [x] A 90-day moratorium has been placed on the enforcement of evictions of residential and commercial tenants. - [x] Driver’s licenses that expire on or after March 1, 2020 shall remain valid. - [x] All vehicle registrations that expire on or after March 1, 2020 shall remain valid. - [x] Notarial acts have been authorized to be performed utilizing audio-video technology provided that certain conditions are met. - [x] Any deadlines for commencing, serving or filing any action, proceeding, notice or motion under the NY Civil Practice Law and rules have been extended until April 19, 2020.

In order for an APLS, including an attorney, to act on the client’s behalf, they must have a letter of Authorization and Fee Agreement signed by rightful owner (or authorized estate representative), witnessed and acknowledged before a notary public. The agreement must also disclose that abandoned funds can be obtained directly from the OSC without paying a fee. Moreover, the maximum fee allowable is 15% of the funds recovered.
