From founding partner Sabrina E. Taub, Esq.- A sad reality that I deal with are clients who have suffered traumatic brain injuries. Like a concussion that a football player might suffer in a game, so too can someone suffer head trauma in any kind of accident. A sharp blow or jarring of the head can cause a traumatic brain injury also known as a "TBI." In the past I have represented clients who suffered traumatic brain injuries in car accidents, truck accidents, work-relat...ed accidents (such as falling from a scaffold), slip and falls and many others. There are many ways one can suffer these devastating brain injuries which can affect not only the victim but also his or her family. Symptoms from a brain injury can be felt immediately but others take weeks, even months to develop. I have seen first hand how these types of injuries can affect a person. They often have slurred speech, confusion, and cognitive difficulites such as word retrieval problems or memory loss. They suffer from headaches or personality changes. It is my job to represent these individuals zealously, as I know the types of financial and emotional burdens these injuries will place upon them and their families. I am keenly aware of the difficulties often associated with representing these victims as the insurance companies and their defense attorneys routinely try to deny that these symptoms, which are often times subjective in nature, do not exist. I am also keenly aware of the emotional support that victims of traumatic brain injuries need. We are here to offer guidance and know the types of diagnostic tools required to diagnose a traumatic brain injury. The updated guidance on the Executive Order is now posted on the ESD website.... ***May 13th, 2020: This is a public service announcement for New York State pet groomers and pet owners alike. Due to the efforts of attorney Sabrina E. Taub, Esq. of The Selvin Law Firm, dog grooming services for the health of pets can resume in the State of New York. On Monday, May 11, 2020, Ms. Taub was able to effect a significant clarification of the essential business mandate concerning pet groomers in the State of New York, which, up until Monday, was vague with respect to animal care. Ms. Taub learned of the discrepancy in the Executive Order when she attempted to bring her dog to a local Long Island storefront groomer. She learned that local pet groomers were receiving violations from the Fire Marshal due to the unclear wording of the Order, which deemed "animal shelters and animal care including dog walking and animal boarding" as essential. Ms. Taub argued that pet grooming should be considered an essential business within the definition of "animal care." Pet grooming is not merely an asesthic service; it is often medically necessary on smaller dogs that can otherwise develop infections and hot spots if left unchecked. In addition, it has been reported that pet owners have been attempting to groom their own pets at home and are unintentionally hurting them with scissors and clippers, requiring expensive trips to the vet! The Selvin Law Firm has now obtained written confirmation from the Nassau County Fire Marshal via the Empire State Development Corp., that animal care, including pet grooming, which is performed for the heatlh of the animal as part of a veterinarian guided care plan, shall be permitted. "So long as the pet groomer advises that they are operating their business to maintain the health of pets we will no longer issue violations for this Essential Service." Facial coverings and social distancing requirements, however, must be followed. If you operate a pet grooming service and have additonal questions, please feel free to contact our office. What that means is that they are safe from civil liability for any injury or death alleged to have been sustained directly as a result of an act or omission by such medical professional. However, there is NO IMMUNITY if it is established that such injury or death was caused by the GROSS NEGLIGENCE of the medical professional.... This article identifies an issue that we are hearing from many people calling our office. Gross negligence leading to unnecessary deaths; especially with Black & Hispanic patients. Improper intubations & chest compressions, wrong insulin administration and other incidents of gross negligence are not immune from liability. We are all appreciative of our healthcare workers, but if your loved one dies because of gross negligence during this pandemic, it might be appropriate to investigate further and seek justice for the careless events that may have caused that death.
