OCCUPATIONAL EXPOSURE CLAIM DURING THE COVID-19 CRISIS (CORONA VIRUS) Notify the employer of an exposure. Document the date, time and location along with the name of the supervisor notified. Keep a journal of the events. ... This is a new frontier for not only the nation but also the Workers' Compensation Law. It is expected, these claims will be litigated! Documentation will be essential. DOCUMENT, DOCUMENT, DOCUMENT! The exposure needs to be documented. Write it down! NOTIFY, NOTIFY, NOTIFY! The employer needs NOTICE. Let the boss know ! DOCUMENT, DOCUMENt, DOCUMENT Write down the supervisor you informed! Injured at work, we are here to help! Vecere & Travaglia, LLP 631-913-4444 As in any case in which you are injured at work through an occupational exposure, industrial sickness from COVID-19 or Corona Virus should be handled the same. If a specific situation arises, in which you are exposed to someone known to have the COVID-19 virus or someone experiencing symptoms consistent with the virus, please record the time, date and location of the event. You should write down the exact employment activity you were involved in and keep a precise record of the occupational event. You should immediately notify a supervisor of the incident. Record the date, time and name of the supervisor notified. Record the names of all witnesses and individuals involved. Obviously, if you never become sick, the exposure was just an exposure and thankfully you never became ill. However, if you develop symptoms and become afflicted with the virus, you must articulate to your physician the "industrial / work related" exposure you recorded. Your physician must take a history of the prior work related incident. This medical report is of the utmost importance in processing a Workers' Compensation Claim. As with any injury, we highly suggest calling our office for assistance preparing a New York State Workers' Compensation Board C-3 Form to start your claim. Obviously, every situation is different and this pandemic is an evolving dynamic. These claims "may not" just be limited to Healthcare Workers', Law Enforcement Personnel, Emergency Medicine Technicians, etc. It will be a case by case determination. We can not stress enough, documentation will be necessary to prove the "industrial" or "work related" sickness component to your claim regardless of occupation.
