American Repertory Theater of WNY 21.09.2020

American Repertory Theater of WNY recently discussed the moratorium on live theater and performance venues with a lawyer who's firm is familiar with legal rights related to these imposed mandates and Governor's Executive Orders regarding the closing of non-essential businesses which include performance venues. In interpreting the ongoing Executive Order on the closure of performance venues, the lawyer found the possibility of seeing theaters and performance venues reopen by ...Spring 2021 highly unlikely as the Governor finds these businesses to have health risks due to congregation. The only means that the Governor would amend the Executive Order and reopen performance venues would be a vaccine that allows people to safely attend these live events. As indicated by Health experts, the COVID 19 vaccine may not be widely available for another year or more. This correlation will leave theaters and live performance spaces dark for another year or more. The advice the lawyer offered was to continue to write State & Local leaders and push for an exemption to the current Executive Order due to capacity and programming. ART/WNY continues with the company's petition http://chng.it/kkW66MSnmL to push for the dialog and encourages all in the Dramatic Arts and Performing Arts to review and sign the petition. Otherwise, just sit it out and wait the next year or so for the Governor to decide when it's safe to reopen. ART/WNY will continue to fight to remain open and encourages all those who are involved in the Dramatic Arts that this isn't a situation that'll go away in the next few months. The absence of live theater and how it pertains to the community will have a lasting effect. The longer companies remain dark, no matter if its a large or small capacity, the impact it makes on shaping our communities becomes less and less. Please make your voice heard http://chng.it/kkW66MSnmL #nygovcuomo #senschumer #saveourtheaters #saveourtheater #buffalotheater #buffalotheatre #wnytheatre #716buffalo #theater #theatre #newyork #newyorktheatre #newyorktheater #governorcuomo #newyorkstateofmind

American Repertory Theater of WNY 02.09.2020

American Repertory Theater of WNY stands behind the efforts of Riviera Theatre's and Performing Arts Center's Executive Director David Fillenwarth in bringing attention to local & state officials the need to reopen theaters and performance venues. His efforts act as a uniting force for those companies that, with proper safety guidelines, occupancy restrictions, changes to programming, and thorough box-office management to oversee crowd flow, want to reopen after six months of... being shutdown. The COVID 19 virus doesn't have a timeline for when theaters and performance venues can reopen. It won't wait until March 2021 to go away. Advancement in treatments are within foreseeable sight but a vaccine will not be widely available for atleast a year. We have to adjust to living with this virus and, like live-music venues, bars, restaurants, casinos and gyms, can reopen safely with proper guidelines and capacity requirements. Unfortunately, the theater community remains relatively passive regarding this issue and are quietly opting to stay shut until Spring 2021 producing virtual presentations. Although efforts are being made to remain solvent, most theaters and performance venues cannot withstand closing for any more prolonged period of time and risk closing their doors forever. The time for action is now before the diversity among our theater community will be gone, local playwrights who need progressive forums to fully present their full-length works won't have the chance, unknown or unproven actors won't get the opportunity to present their crafts, and strides to bring inclusivity to our stages will stop. This moratorium hurts us ALL and now is the time to speak up and find the means to safely reopen.

Sportsmen's Tavern just won a lawsuit against NYS regarding the advertisement of live music and selling tickets to live music events. According to the attorney representing them, The state agreed that we could advertise so-called background music, butour position was that it was an impediment of free speech because it’s content-based. Secondly, we’re already bound by all the safety and capacity regulations, so it doesn’t matter how people come to the establishment. The o...verturning by New York State Supreme Court Justice Frank Sedita allows for the Sportmen's Tavern to operate normal business operations within the already practiced guidelines for capacity and safety. If small venue theaters and performance venues offer the same safety and capacity regulations then the same rights should be applied to them. These businesses, such as the American Repertory Theater of WNY, are suffering and some face shutdowns from unfair standards set by NYS. An ongoing petition planned to be sent to Governor Cuomo and NYS Senator Charles Schumer has been gathering signatures. Please review the petition, sign and share. The dialogue needs to start now as the COVID virus won't stop being part of our lives in March 2021, and the guidelines for reopening need to be implemented by year's end. http://chng.it/kkW66MSnmL #nygovcuomo #senschumer #saveourtheaters #saveourtheater #buffalotheater #buffalotheatre #wnytheatre #716buffalo #theater #theatre #newyork #newyorktheatre #newyorktheater #governorcuomo #newyorkstateofmind

The Director of Intergovernmental Relations for Empire State Development confirmed that the Governor has received company request letters for reopening and has now assigned this Director to review the matter and report back to Albany expressed concerns, the need for discussion regarding guidelines for reopening, and the moratorium’s impact on theaters and performance venues. This effort marks a significant step in jumpstarting the dialogue into the reopening of our theaters;... however, the pressure needs to continue to be placed on our leaders. We need to show them that theaters are beneficial & essential businesses for our community, and if given the guidelines, can safely reopen our doors to the public.
