Huge win for Layliev Law PC and it’s Client this year. We successfully regained control of a three family home in Jamaica Queens, which was illegally converted into 11 separate units. This saved the property owner from having to issue rent stabilized leases to the illegal units, and allowing the building to continue free market rents. In New York, if a 2-3-4 family home is rented out with six or more separate tenants or rooms, legal or illegal, and the building was built befo...re 1969, it can be considered rent stabilized. We were able to argue that (i) issuing rent stabilized leases in this building would actually create LEGAL IMPOSSIBILITIES and (ii) the first rent stabilized rents were actually market rents and NOT acceptable to the tenants. Property owners and managers might be able to create huge profits by renting individual rooms instead of an entire apartment, but must be aware of the severe and long term consequences for the building which could cripple future rental cash flow for the building even for future owners. This would also make the property very difficult to sell to future investors.

NYC PASSES MORE LAWS AFFECTING THE REAL ESTATE INDUSTRY Last year, NYC started the Certificate of No Harassment program which made it very difficult (1-2 year process) for building owners to get permits and plans approved for construction while the city checks whether the Owner ever harassed its residential tenants, and almost impossible to get permits if they were guilty of harassment. This program will now apply to commercial landlord too, with higher fines (up to $50,000) as well as denial of building permits and plans by DOB.

Last week, New York passed a new law which requires that in all real estate transactions, an LLC must disclose the names of all of their owners. Last week, our office received a favorable decision after a lengthy trial on behalf of a landlord against a commercial tenant. The decision allows a landlord to evict a tenant for not paying many years of rent increases EVEN THOUGH the landlord NEVER billed for those increases. It is not always necessary to send billing statements and Tenants cannot assume that a landlord waives charges when they do not bill for them.

New laws are being passed in NY which will help keep rents lower for residential tenants. As real estate taxes, minimum wages, and the cost of maintaining property goes up, these new laws may cause real estate prices to drop and investors to invest their money outside of NYS. After 2 1/2 years of vigorous litigation, this office has prevailed in obtaining numerous judgments against a commercial tenant who demonstrated a complete disregard for the law, practicing attorneys and sitting judges. in 2016, we represented a landlord in a traditional holdover proceeding against a commercial tenant located in Queens County for numerous lease violations. During the course of very tense and aggressive litigation to retake the valuable commercial space, our ...office: (i) defeated an early motion for dismissal, (ii) obtained a judgment of possession to evict the tenant (iii) was successful when the tenant appealed the decision at the Appellate Term Second Department, and had the appeal denied, (iv) prevailed two times in the US Bankruptcy Court to lift a stay/freeze of the eviction process, (v) evicted the tenant from the property, (vi) got our client approximately $80,000.00 in payments during litigation by court orders, (vii)obtained numerous money judgments for our client for unpaid rent, unpaid real estate taxes, late fees, and legal fees totaling over $120,000.00, and (viii) began enforcing the money judgments against the tenants assets.
