Happy #TravelTuesday ~ we had a great day hiking through North Cheyenne Cañon Park in Colorado Springs yesterday. So many great trails. We made it to the summit of Mount Cutler, Mount Muscoco, and the Middle Columbine. We saw beautiful birds, wildflowers and a waterfall. The North Cheyenne Creek runs along the bottom of the canyon. Happy Monday from Colorado! There is so much natural beauty here and so many great hiking trails. We spent Saturday in the majestic Rocky Mountain National Park. Elevation 7K -14K feet above sea level. We hiked across frozen Granby Lake; we hiked to the Holzwarth historic site; and finally, we hiked out to Adams Falls. There are no words for the grandeur of the Rocky Mountains. On Sunday, we enjoyed hiking through Paint Mines Interpretive Park in El Paso County. The... Paint Mines are named for their colorful clays that were collected by Native Americans to make paint. Brightly colored bands, caused by oxidized iron compounds, are found in varying amounts throughout the many different layers of clay. The Paint Mines Interpretive Park features fantastic geological formations including spires and hoodoos that form through erosive action that creates incised gullies and exposed layers of selenite clay and jasper. Truly amazing. So many hikes, so little time! The Chief Judge of NYS has issued a new administrative order which will become effective February 1. This will be of great significance to attorneys who practice Civil law. Among the changes: - Appearance Counsel MUST have knowledge and authority of the case (Exhibit A) - Interrogatories LIMITED to 25 in number (Exhibit G) - LIMIT on number of depositions and number of hours per deponent (Exhibit J) - Sanctions PERMITTED for non-compliance with a discovery schedule (Exhibi...t M) - Prior to submission of a discovery motion, the attorney MUST attempt to resolve discovery issues. THOMAS GIRARDI FALL FROM GRACE - One of the country’s premier toxic tort lawyers is accused of stealing money belonging to families of victims of the Plane crash that led to the grounding of Boeing’s 737 Max. And that’s just the beginning. Thomas Girardi was one of the lawyers for Erin Brokovich that resulted in a settlement of hundreds of millions of dollars and established the toxic tort business. Court papers allege that the 81-year-old lawyer has allegedly stolen mill...ions of dollars from plane crash victims that he was supposed to hold in trust. His once venerable law firm has collapsed and is in bankruptcy, he’s being sued by multiple creditors, is in debt he cannot repay, and is facing criminal prosecution. The lawyer’s brother is seeking legal guardianship of him, saying Girardi has a diminished mental capacity. Girardi is also involved in a divorce from his wife, a reality star. RESTAURANTS FILE CIVIL RIGHTS LAWSUIT - A group of 70 New York bars and restaurants have filed a lawsuit against Gov. Andrew Cuomo alleging that the state’s constantly changing dining regulations violate the businesses’s civil rights. Many restaurants have spent thousands of dollars reconfiguring outdoor and indoor spaces to comply with pandemic health safety regulations, only to have those regulations shift without much warning and be forced to spend more money to stay in co...mpliance. This lawsuit is the latest in a string of legal actions that the NYC restaurant industry has taken against the state government throughout the pandemic. A $500 million class action lawsuit filed in September aimed to lift indoor dining capacity in the city to 50 percent, to match dining allowances in the rest of the state, but it was thrown out in November. In December, several restaurants filed suits against Cuomo in an attempt to put a halt to the city’s second indoor dining ban, which is still ongoing.

NYS CONSIDERING LAW TO LEGALIZE Mobile Sports betting ~ NYS needs money. The Governor has repeatedly turned down legalized betting legislation but then New Jersey generated over $930 million in one month of legal sports betting, most of it online. In a statement yesterday, Gov. Cuomo said he will announce his plan for legal sports betting in New York during his State of the State address later in January. New York has the potential to be the largest sports wagering market in the United States, and by legalizing online sports betting we aim to keep millions of dollars in tax revenue here at home, which will only strengthen our ability to rebuild from the COVID-19 crisis, Cuomo said. https://www.google.com///06/ny-legal-sports-betting-update

NEW YORK LEGISLATURE changes labor laws in 2021. The minimum hourly wage in New York State will rise to $12.50 from $11.80 in every part of the state outside New York City, where the wage is $15/hr. In Westchester County, and Long Island the minimum hourly wage is now $14.00 Workers in the state will be eligible for 12 weeks of paid family leave and able to receive 67% of their weekly earnings- up to $971.61 a week. New York State will now review cases decided by Supreme Court justice with early onset Alzheimer’s - ShawnDya Simpson, age 54, had been one of the youngest judges to put on robes in New York’s court system when she was elected to the Civil Court in Brooklyn in 2003. Simpson was forced to retire this summer, when it was revealed that she had been suffering from early onset Alzheimer’s disease. Acting on complaints of erratic behavior, delays in issuing decisions and the failu...re to reliably show up in her courtroom, the State Commission on Judicial Conduct worked to negotiate an end to Simpson’s career once her medical condition had been officially determined. From Forbes Magazine: President Donald Trump’s campaign is reportedly preparing a range of lawsuits alleging voter fraud to challenge his election loss, but many of the leaders of this rapidly arranged nationwide legal effort which most experts believe will have little to no chance of success are not lawyers.
