One of the biggest myths that I hear from clients in New York is that if they go onto Community or Nursing Home Medicaid, they will lose their AARP, Empire, or other insurance. THIS IS NOT TRUE!! You can be on Community or Nursing Home Medicaid in New York, and still keep your other insurances, so long as you continue to pay the premiums. In fact, whatever you pay each month in premiums, is deducted by Medicaid from your income. ... Do not assume that what your neighbor’s daughter’s roommate’s cousin who is a Medicaid expert in Kentucky said, is true for you. Please, if you feel that you or a loved one need assistance with daily needs, reach out to someone knowledgeable to see if you are eligible for Medicaid benefits! "If I am making a Trust and will be transferring most of my assets to the Trust, why do I need a Will?" Short answer - you don't NEED one. Long answer - we can't predict the future. What if something wasn't transferred to the Trust? A client of mine made a Trust, and after she passed away, her son found an old stock certificate in her night table drawer, worth about $140,000! What if money comes in to your name after you pass? Think proceeds from a lawsuit or tax refund A Pou...rover Will is a type of Will that leaves (pours over) everything that may be in your name when you pass away, to your Trust. Your Trustee would then distribute everything pursuant to the Trust terms. Your executor would still need to file a Probate Proceeding with the Surrogate's Court, but going to Court with a Will is generally easier than going without one. See more

What a bombshell! For the first time in many years, New York State has changed its Medicaid eligibility rules! No longer can you transfer assets out of your name (barring rare exceptions) and immediately qualify for Community Medicaid (home care)! For anyone who will not be applying for Community Medicaid prior to April 2021, there will be a 30 MONTH WAITING PERIOD from the date you transfer assets out of your name, during which you will not be eligible for Community Medicaid.... Privately paying for home care services can cost upwards of $10,000 a month.
