Just moments ago, Governor Cuomo signed legislation to ensure that New Yorkers have greater protection when seeking care in hospitals and doctors’ offices across New York State during the COVID pandemic. ... You may have heard that the governor initially signed a law offering broad protection to nursing homes and other healthcare facilities when caring for COVID patients. Today, the governor made it more difficult for a nursing home or other healthcare facility to escape liability in the event of a negligence lawsuit. This is very important for all New Yorkers. Before, we have been forced to reject many inquiries at our office regarding COVID related deaths of family members in hospitals and nursing homes who had entered the facilities COVID free. Today, Governor Cuomo signed Executive Order 202.14 to continue the modification and suspension of laws relating to the disaster emergency. In addition to seve...ral other provisions addressing the COVID-19 outbreak, the Executive Order extends the provisions tolling the Statute of Limitations until May 7, 2020 and allows certain witnesses to perform using audio-video technology. NYS Academy of Trial Lawyers: Important Courts Update - Non-Essential Matters Start April 13th Dear Academy Members and Friends, The Unified Court System distr...ibuted a Press Release yesterday announcing that courts statewide now have the capacity to hear all essential and emergency court matters virtually by video or telephone. Today, Chief Administrative Judge Marks has announced that the courts will begin to address non-essential pending cases, including tort, medical malpractice and asbestos, commercial, matrimonial, trusts and estates, felony and others, on Monday, April 13th. Court conferences regarding these pending cases will need to be conducted remotely via Skype or telephone. The filing of NEW non-essential cases continues to be suspended.
